Republican Roll Call on Elena Kagan Nomination.

Elena Kagan has officially been confirmed as the 112th United States Supreme Court Justice and I am pleased to report that close to 90% of our Republican Senator's opposed her Nomination, which is something special when you take into account the lack of judicial filibuster's or even opposition by Republicans in a historical or present sense to Supreme Court Nominee's.

36 Republicans voted no, only 5 Republicans voted yes. And if you remember as I do, close to a dozen Republicans supported Sonia Sotomayor last summer, while a majority (29) opposed, and I have just one more thing to note on this subject: Senator Nelson was the only Democrat to oppose Kagan.

Any thoughts as to how our Republican dissidents should be handled?

How many Republican Senators will oppose Kagan?

With the Senate Judicial Committee voting on the President's second Nominee to the United States Supreme Court, current Solicitor General Elena Kagan this week, and with the entire US Senate voting on her Nomination within the next few weeks, I feel it's necessary to rollcall/guess how many of our Senator's will oppose Ms.Kagan.

Let us start with these statistics:

72.5% of the Senate Republican Conference opposed the Nomination of Sonia Sotomayor to the Supreme Court last summer. 11 Republicans supported her.

77.5% of the Senate Republican Conference opposed the Nomination of Elena Kagan to become the Solicitor General last spring. 6 Republicans supported her.

We already know that Ms.Kagan will receive more opposition from Republicans than Sotomayor did last summer, on account of her opposition to Military recruiters on campus, her stonewalling of US Senators, and the fact she is far more liberal than anyone anticipated. However, the expected opposition cannot be determined accurately.

Why?

1. Senator's Cochran, Ensign, and Graham were not present during the entire Solicitor General Senate vote in March of last year.

2. Senator's Coburn, Hatch, and Kyl supported Kagan's nomination for Solicitor General, but we know Hatch opposes her Nomination to the Supreme Court, leaving more speculation in the air as to who could flip one way or another.

3. Senator Martinez is no longer apart of the Senate (he voted against Kagan), as he resigned and was replaced by Senator LeMieux, who just happens to have no record whatsoever on Kagan.

At the least we should be able to expect 35 or 36 Republican Senator's to oppose Elena Kagan's nomination to the Bench, with the entire Democratic Caucus supporting her. That's just a guess on my part, but we'll find out soon enough.

The Second Amendment under President Obama.

When the Obama Administration took over last January; I was understandably concerned about what impact the current White House, when combined with two Democratic controlled Houses of Congress, would have on America's Second Amendment. However, out of all the blunders and all the unconstitutional actions; America's Second Amendment has actually been strengthened over the past 16 months.

Considering the anti-second amendment feeling within the White House; how could America's most important right be strengthening?

1. The National Rifle Association has grown to 4 million members. While other Conservative organizations have benefited from tax, health care and other-in-the-news' issues of general importance; Second Amendment issues have rarely been discussed.

2. After the President was inaugurated last year; millions upon millions of Americans bought firearms, ammo and other gun related items as fast as they could. Reasonable Americans no longer took their Constitutional right for granted.

3. Pro-Gun legislation has been passed across the United States; from Tennessee to the Halls of Congress. Legislation to allow Right-To-Carry gunholders to carry weapons across state lines almost passed in the Senate; and pro-gun language absolutely stalled the "Washington DC" voter rights act.

It's true that Sonia Sotomayor has been confirmed as a Supreme Court Justice, and that Elena Kagan will also be confirmed to the Court and will oppose our Second Amendment rights as well; but a slim Court majority of 5 Justices should forever stop Cities such as Chicago from prohibiting local gunowners from possessing firearms, when the McDonald v. Chicago case is eventually decided.

While every other part of the United States Constitution has been threatened, raped and harassed by officials within the Obama Administration; the Second Amendment has survived and thrived under a seemingly hostile White House; proving the political hazard of messing with America's most important right.

Joe's Babe of the Week

Dr. Joe comes to you writing from the New York annual sex convention, where yours truly has been picking up a lot of new things that I'm bringing back to the blog. I'm studying to get my PhD in Shagology and anyone who would like to be my research assistant, please call me at 555-JOEC.

Sonia Sotomayor

Born in the same Impala that yours truly was conceived in, the future Justic Sotomayor was destined for greatness. Graduating from high school with recommendations from the chief custodian, Ms. Sotomayor wowed the crowds during her entire college career: six years at South Los Angeles Community College.

After receiving an AA in Criminal Justice, Ms. Sotomayor whined herself onto a local criminal court. After seeing how foxy the young Latina was, former President George H. Bush picked her to serve on a circuit court of appeals. After President Obama spent four hours looking at her melons earlier this year, Sonia was chosen as the first Latina, and by far the hottest, Supreme Court Justice.

The regret of pro-second amendment Senators who support Sotomayor coming to an election booth near you.

Traditionally, once a Justice to the Supreme Court is confirmed and takes the oath of office, the second guessing ends. That will not be the case with Justice Sonia Sotomayor.The Supreme Court will be hearing numerous important cases when the Court returns into session, including a large second amendment case, a crucial freedom of speech case, and a do or die economics case.

While the freedom of speech & economic cases are very intriguing, the important second amendment case could shape America for decades to come. Perhaps even more important then the Heller case which confirmed the Individual right to keep & to bear arms.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

While Conservatives attempt to preserve the second amendment, liberals are always developing a new talking point to combat the second amendment, the latest one is dubious at best, that the states & local communities can ban guns because the Constitution applies only to the federal levels.

Considering all Americans, no matter which state they reside in, have the right to bear arms, which shall not be infringed, any highschool drop can understand that - All Americans have the right to bear arms, which shall not be infringed by anyone, whether at the federal, state, or local government level, that right to bear arms still remains, it can no more be banned then the freedom of speech.

If the Supreme Court ruled on the side of second amendment in this crucial case, it would declare all gun bans illegal, as no-one has the authority or right to tell an American citizen anything in regards to owning arms. Some might claim the tenth amendment, let me refresh your memory - "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the state respectively, or to the people" = second amendment is a delegated right to the American people, to be protected by the federal government, no-one can touch it.

That's the way it was intended, that's the way it should be.

The said Constitution shall be never construed to authorize Congress to infringe the just liberty of the Press, or the rights of Conscience; or to prevent the people of the United States, who are peaceable citizens, from keeping their own arms - Samuel Adams.

Sotomayor has ruled the second amendment means nothing to the states, when all states that join the Union - enter into a contract with the Constitution, can we expect any better from Sotomayor on the mentioned above second amendment case? No.

I also wanted to offer my deepest condemnation of Republicans Senators Voinovich & Lugar, who both voted against the right to carry amendment which was brought up in the United States Senate, which would have allowed legal law-abiding Americans to defend themselves with their arms, following local laws in 48 states across America. The second amendment applies to all states, the people have the right to bear arms & defend themselves in all states as well.

This is an American right, not a state-by-sate right.

Those who dare call themselves pro-second amendment, then voted for Sotomayor, Republican or Democrat, watch out for the backlash.

BREAKING: Obama Expects "In God We Trust" to be Removed From Currency by Sotomayor

FOR IMMEDIATE RELEASE

WASHINGTON- Seemingly in line with speculation that Judge Sonia Sotomayor is going to further separate "government and religion," President Barack Obama has stated that he hopes Sotomayor will help remove "In God We Trust" from American currency.

This proposal is similar to concerns that the President nominated Sotomayor to remove "under God" from the Pledge of Allegiance. However, removing the iconic phrase from money could prove more difficult.

"There is a clear distinction between religion and the government," Obama stated Tuesday. "The Bill of Rights states clearly that freedom of religion is guaranteed in our country. But it must be remembered that the right not to believe is also guaranteed.

"The government prints and casts our money, and we back its value. And on each piece of currency, "In God We Trust" is printed. Who are we to force our belief in God on people who don't believe in a God, or believe in multiple gods?

"Our money is possibly the most visible aspect of the United States. It is used to buy oil in the Middle East, it is used to buy a loaf of bread in Montana. We cannot and we should not force our views on people throughout the world. I believe in God, but I will defend the right of people to believe there is no God.

"One of the great strengths of the United States is, as I have mentioned, we have a very large Christian population; we do not consider yourselves a Christian nation or a Jewish nation or a Muslim nation. We consider ourselves a nation of citizens. Who are bound by ideals and a set of values?

"Therefore, it is my hope that the Supreme Court, with Miss Sotomayor's help, will declare "In God We Trust" unconstitutional," the President concluded.

Other groups are apprehensive about the President's nominee, including those who fear that she defend Roe v. Wade. However, it must be noted that Sotomayor is only currently a nominee, and that she must be accepted by the Senate.

Judge Sotomayor could not be reached at the time of this release.

Obama picks radical for SCOTUS.

I'll be honest, I want to discuss North Korea, and how we should begin the process of declaring war against this tyrannical dictatorship - as they are directly threatening America's security, and our allies security, however I must discuss a homegrown threat being nominated to the Supreme Court instead. When it was announced Justice Souter would be retiring from the United States Supreme Court, Conservatives including myself knew the choice to replace Souter would be a hard line Liberal, I worried Sonia Sotomayor would be the nominee, because of her belief that being a women & a hispanic outweighs the letter of law.

To my disarray, Sotomayor was selected by Obama to replace Souter on the Supreme Court, and the most recent information I have learned about Sotomayor is deeply disturbing, and just downright wrong.

Example of a recent case, that Sotomayor dealt with, and the Supreme Court is deciding now :

The New Haven Connecticut fire department was having a big exam to field possible candidates for a promotion, firefighters studied for weeks at a pace of hours a day for this exam, when the exam came, several firefighters passed the exam - expecting a promotion, however none of the firefighters were black - and afraid of a lawsuit & racial quotas, the fire department promoted no-one.

The violated the Constitution, and has shown what a failure of a system affirmative action is - not to mention just wrong, and unethical. The firefighters sued the city of New Haven and Sotomayor when the case was brought to her, instead of siding with the firefighters just wanting merit performance & rewarding success when it comes to employees, stood for un-constitutional racial quotas - a dangerous example of this womens radical beliefs. According to news reports, the Supreme Court has overturned 60% of Sotomayor's majority opinions.

Sotomayor also believes that latina women would make better judges then white males, which once again violates the law being followed ethic.

Sotomayor is also described as bullish, demanding, and thinks highly of herself - this from liberals who seriously dislike her, she has also made numerous other idiotic comments & statements that should be used against her, and is also for the most part anti-business, as shown when acorn connected SEIU praised the nomination.

It all comes down to this :

Obama has nominated a judge based on personal feelings & "diversity" of the court, which has nothing to do with the letter of the law, and violates the Founders want of Supreme Court judges who would follow the law & Constitution - instead of incite personal rancor & legislate from the bench.

Will the Republicans oppose or accept the radical?

They should oppose her at all costs.

But will they?

40 Republican Senators, and perhaps a brave few Democrats could derail this radical empathy driven Sotomayor, or will they succumb to political pressure?

Twenty years of Sotomayor on the court is at stake, we must oppose at all costs.

Note : Sotomayor also has hostile views towards the second amendment, and believes the states & local communities have the right to violate the second amendment, as the second amendment only applies to the federal government, this claim is sickening - as the Bill of Rights, protects the most sacred rights that cannot be touched by anyone - Federal, State, or Local. Lets also remember the history of the bill of rights, the states made a list of rights they wanted in the bill of rights, the Founders eventually selected twelve (only ten passed at the time), including the second amendment.

Sotomayor: Gun Ownership "Unconstitutional"

President Obama has made a bold choice to replace Supreme Court Justice David Souter with Appeals Court Judge Sonia Sotomayor. Ms. Sotomayor, if confirmed, would be the first Hispanic Justice and would be only the third woman on the Court.

Sotomayor's resume is impressive, including a 1993 ruling in favor of a homeless man beaten by NYPD officers and her landmark decision in 2002 regarding terrorism suspects. In that case, she determined that suspects captured on the battlefield must receive all rights afforded to American citizens under the Constitution. Her controversial decision was later overturned by an Appellate Court, but still influenced current policy.

Sotomayor is a graduate from Princeton University, where her legal theses included Race in the American Classroom, and Undying Injustice: American "Exceptionalism" and Permanent Bigotry, and Deadly Obsession: American Gun Culture. In this text, the student Sotomayor explained that the Second Amendment to the Constitution did not actually afford individual citizens the right to bear arms, but only duly conferred organizations, like the military. Instead of making guns illegal, she argues that they have been illegal for individuals to own since the passing of the Bill of Rights.

Ms. Sotomayor's story is certainly one of success over adversity. Despite growing up in the projects, she has risen to become one of the most well-respected legal minds by the American left. Before joining the appeals court, Sotomayor was a legal consultant for the NYCLU.

Even with her meteoric rise, the nominee still believes there is work to do. In a 1999 interview with a local author, Sotomayor stated that she believed that the United States, "...may never truly be fixed. Racism and economic warfare still crush the dreams of countless second-class citizens. The unfair dimensions of our culture are staggering. You cannot succeed if you are born poor; you simply cannot."

The nomination is expected to go before the United States Senate where Republicans may give a strong fight against what may be considered "judicial activism."
