I have, perhaps, just read the greatest legal opinion from the United States Supreme that you will ever hear. It is from Chief Justice Rehnquist in regards to Texas v. Johnson, in which a crazy left-wing nutjob stole & burned an American flag in public view at the 1984 RNC in Dallas Texas. The majority of the court ruled that the flag burning statutes were Un-Constitutional, something any fool can realize is idiotic, however....Chief Justice Rehnquist stood for the American flag, and stood for the Constitutionality of the United States Congress & the fifty states independentlyto ban the public burning of the American flag.
We are not talking about stopping Freedom of Speech, or protest, we are talking about protecting the greatest symbol of America, and American freedom, which does not violate the first amendment. How one can argue that banning the practice of burning the flag is against the first amendment, I really cannot understand it, especially when it is the United States job to care for, regulate, and to protect the flag at all costs. Plus, burning draft cards is un-Constitutional (violates the clause which declares that Congress has the right to raise up an Army), so why shouldn't burning of the American flag be classified as the same?
That is why I personally support a Constitutional amendment to ban flag burning, and I am very pissed we have always missed sending the amendment to the states by one or two votes, usually the vote of a drifting Republican Senator, which angers me even more (please note : Nearly 50-55% of the supporters are Republicans, not surprisingly).
Please read Chief Justice Rehnquist's opinion - http://www.law.cornell.edu/supct/html/historics/USSC_CR_0491_0397_ZD.html
I do not care if you curse, damn, slander, etc. the American flag, but to publicly disregard the United States flag, and then claim freedom of speech, I am sorry, but your excuse is just plain wrong.
Please note : the proper practice to retire the flag is to burn it, we are talking about burning it to make a lously political point.
